When Kane was sent to the AHL, the Sharks claimed that Kane breached the AHL COVID protocols and therefore they felt that they were justified in making the move to terminated his contract, but Kane's agent Dan Milstein felt differently.
Kane's party immediately filed a grievance with the league and we have yet to hear about a ruling on the matter, but yesterday it became clear that a resolution between the Sharks and Evander Kane is very unlikely to happen.
Both sides seem to care more about being right than actually reaching a settlement.
Oilers beat reporter, Daniel Nugent-Brown, stated that neither side are willing to budge on the matter:
On Evander Kane's grievance case:
Doesn't sound like there will be a settlement.
DNB: "It sounds like both sides have dug in their heels with the Sharks determined not to pay him a cent and Kane eager to clear his name." Oilers Access (@oilersaccess) September 8, 2022
We are not expected to see a ruling on the case before the regular season, and it will cause a bit of a dilemma depending on the ruling as Kane is currently under a new contract with the Oilers. But in the event that Kane is awarded his contract back with San Jose, we will most likely need to see a trade facilitated between the Sharks and Oilers to send Kane back to Edmonton.
He'll still play. There is an unlikely scenario where Kane wins the case and goes back to the Sharks then the Sharks would have to trade him to the Oilers which might cause him to miss some games, but again, this scenario is unlikey to happen. Oilers Access (@oilersaccess) September 8, 2022
